MPT files a lawsuit against outsourced company and UFS for lack of payments and undue discounts

The Public Ministry of Labor in Sergipe (MPT-SE) announced, this Monday (15), that it filed a public civil action against an outsourced company and the Federal University of Sergipe (UFS), due to constant delays in the payment of salaries, in addition to undue discounts on employees' paychecks.
The MPT reported that almost 200 workers had been penalized for the conduct of the company, which provided services to the UFS. In the complaints received, the lack of payment of salaries, thirteenth salary, FGTS, vacations, food vouchers and transport vouchers was highlighted.

The agency also received other complaints that employees reported that they were forced by the company to acquire a payroll loan, as a way of compensating for late payments, and with the condition of passing on the amount deducted from each worker to financial companies, which, according to them, did not happen and several employees had their names negative. According to the MPT, some workers reported that they were evicted from their homes because they were unable to pay the rent.

The MPT also stated that it tried to sign an agreement with the company, but was unsuccessful, alleging delays by UFS in paying the contract with the outsourced company. The University, in turn, reported that, to minimize losses, since April it has been making payments directly to outsourced employees by bank order.
What does the MPT ask for?
In the action, the MPT-SE requests retention and blocking of money for full payment of outstanding salaries and other labor funds, granting and payment of vacations to workers and monthly payment of FGTS. Furthermore, the agency also states that the company should not force employees to take out a loan due to salary default.
In relation to UFS, the MPT-SE requests that all monthly labor rights owed by the company be paid directly until the end of the employment contract, due to default.
In case of non-compliance, the MPT-SE requests the payment of a daily fine of R$ 1,000.00 for each obligation not fulfilled and for each worker found in an irregular situation, in addition to a joint sentence for the company and the UFS for the payment of R$ 100 thousand in compensation for collective moral damage.
What the UFS says
The UFS informed, through a public note, that it started paying salaries directly through bank orders, in addition to working to resolve debts. The university also said that it is investigating the irregularities found and the feasibility of terminating the contract with the company.
The institution expressed solidarity with the affected professionals and said it remains committed to adopting all necessary measures to protect their rights.
