The Supreme Court ruled that notice pay should be paid to employees in fields such as domestic services and agricultural work that are outside the scope of the Labor Law No. 4857. In the unanimous decision, it was emphasized that the terms of notice pay are subject to the provisions of the Turkish Code of Obligations (TBK), and that even if it is outside the scope of the law, notice pay may arise in cases where the employment relationship is based on an indefinite-term contract.
