The decision was signed on Wednesday (10) by federal judge Náiber Pontes de Almeida. The judge understood that the public civil action presented by Fiesp was not the appropriate legal instrument to question the tax reform provisions related to the Manaus Free Trade Zone. Therefore, the process was closed without analyzing the merits. The entity highlighted the importance of tax incentives for the economic model of the Manaus Free Zone and informed that it will continue to follow the discussion. Now on g1 "We received the decision calmly, but without any illusion that the issue is closed. It is a first instance decision, subject to appeal. The PanAmazônia Association will continue to monitor the case and participate in all discussions involving the future of regional incentives", stated the association's executive director, Belisário Arce. On social media, the Amazonas Commercial Association (ACA) highlighted its participation in the process through the entity's legal advice. "ACA participated in the process, through its legal advisor, the firm Pedro Câmara Advogados, as amicus curiae, technically contributing to the defense of the constitutional prerogatives of the Manaus Free Zone", said an excerpt. Senator Omar Aziz (PSD-AM) stated that there was joint action by the Amazon bench to preserve the competitiveness of the Manaus Free Zone. "I trust that, in moments like this, there is no party flag: we will all defend jobs and the Manaus Free Trade Zone as our economic model. We have done all the work to preserve the competitiveness of our industries," he said. Understand the decision The action presented by Fiesp questioned legislation provisions that created presumed Goods and Services Tax (IBS) and Goods and Services Contribution (CBS) credits for companies located in the Manaus Free Zone. When analyzing the case, the judge understood that public civil action could not be used to challenge the constitutionality of the rule. According to the decision, this type of discussion must be carried out through specific instruments, the analysis of which is the responsibility of the Federal Supreme Court (STF). The judge also considered that Brazilian legislation does not allow the use of public civil action to question tax benefits granted by law. For this reason, the process was closed.
