The court canceled the authorization for renovation work on a square located between Ruas 7 and 8 in the Planalto Vinhais II neighborhood, in São Luís. The stoppage occurred because the intervention was being carried out without environmental licensing.

According to the sentence, the State of Maranhão, through the State Secretariat for Infrastructure (Sinfra), and the company GPA Construções e Empreendimentos are prohibited from cutting roots, cutting down trees or removing vegetation from the site without approval from the competent bodies.
From now on, any intervention in the square will require the presentation of a valid environmental license and a detailed landscaping project. The plan must focus on environmental preservation and compensation, needing to be approved by supervisory bodies and validated by the Courts.
Judge Douglas de Melo Martins, head of the Diffuse and Collective Interests Court of São Luís, ordered the State and the construction company to restore the degraded environment. They must replant threatened native trees and affected vegetation.
To do this, it will be necessary to prepare a Degraded Areas Recovery Project, signed by a qualified professional. The plan must be delivered and submitted to the Court within 90 days after the final judgment (when there are no more appeals in the process).
In addition to the replanting, the defendants were ordered to pay compensation of R$50,000 for collective moral damages. The amount will be allocated to the State Fund for the Protection of Diffuse Rights.

The conviction is the result of a popular action filed by Ricardo Luiz dos Santos Castro. He went to court denouncing the degradation of the public square due to the revitalization work, which was taking place without a license and without an indicative sign.
When analyzing the case, judge Douglas Martins based the decision on the Federal Constitution and the National Environmental Policy. According to the magistrate, the intervention in the square with the real threat of cutting down old trees occurred illegally.
In his sentence, the judge stated that the lack of control over polluting activities represents an unquestionable harm to public administration.
