The United States Court of Appeals for the Federal Circuit has since granted a temporary stay of the Commercial Court's order, a measure that was extended this Thursday. In announcing the decision, the appeals court stated that “the federal government has sufficiently demonstrated that it is likely to succeed on the merits of the matter,” among other reasons. The 10% tariff, imposed under Section 122 of the Trade Act of 1974, is set to expire at the end of July unless Congress decides to extend it. The Trump administration has already begun efforts to implement, by that date, new tariffs of a more lasting nature.
