What the defense says To g1, the defense of the impeached councilors said that the retotalization of votes in Rosana occurred because, in the Electoral Court, appeals do not have a suspensive effect. In this case, the TRE decision became effective immediately, even with an appeal pending at the Superior Electoral Court (TSE). According to the defense, the action was filed by a former councilor linked to a political group opposing the current administration. In the first instance, the electoral judge dismissed the request as unfounded and did not recognize fraud in the gender quota, but the decision was reversed by the TRE-SP. The lawyer said that there was no fraud on the part of the councilors, as all the candidates questioned had old party affiliations and effectively participated in the electoral process. He argued that the low vote, in itself, does not characterize a fictitious candidacy. The defense also criticizes the exclusion of women elected for the entry of men after the retotalization and cites case law that, according to him, points to the need to wait for a definitive decision from the TSE. The revoked councilors were awaiting judgment on a precautionary request at the TSE and believe that the decision could be reversed, according to the representative. The trial ended with a score of four votes to three. During the session, the Court ordered the revocation of the mandates of Gislaine Queiroz Fonseca Vasconcelos and Marcelo Aguiar Cavalheiro, elected by the federation formed by the Brazilian Social Democracy and Citizenship Party, in addition to Angelo Aparecido de Andrade, from the Democratic Renewal Party. Solidariedade did not elect any candidate in the election. Gislaine was the current president of the Municipal Council of Rosana, while Angelo held the position of vice-president of the House. In addition to the revocations, the court ordered the revocation of the Demonstrative of Regularity of Party Acts (Drap) and the annulment of all votes received for the position of councilor by the parties involved. According to the author of the action, the candidates had obtained an insignificant vote and presented low or no movement of resources, in addition to the absence of campaign acts, which would constitute a violation of article 10, §3, of Law nº 9,504/1997. The aforementioned legislation establishes that, in proportional elections, each party or coalition must fill a minimum of 30% and a maximum of 70% of candidates of each sex.
