STF analyzes appeal that could annul acquittal in the Mariana Ferrer case

The Federal Supreme Court (STF) began judging this Wednesday (17) the request to annul the process that acquitted businessman André de Camargo Aranha of the accusation of rape against digital influencer Mariana Ferrer. The crime allegedly occurred in 2018, at the Café de La Musique nightclub, in Florianópolis.
The case reached the Supreme Court through an appeal presented by the influencer’s defense. She claimed that the humiliation suffered during the hearing of the case, which went viral on social media, should lead to the annulment of the acquittal.

During the process in which the businessman was accused of rape, Mariana was heard as a victim and experienced embarrassing situations caused by the accused's lawyer.
The defender's statements were not rejected by the judge in the case and caused victimization of the influencer, who was questioned about her clothes and her sex life.
Today's session was dedicated to the arguments of the parties involved in the process. The trial will resume this Thursday (18), when the vote of the rapporteur, Alexandre de Moraes, and the other ministers will be given.
Indictment
During the arguments, lawyer Júlio Cesar Ferreira da Fonseca, representing Mariana Ferrer, defended the nullity of the process in which the accused was acquitted.
Fonseca said that the scenes at the hearing were appalling and that Mariana was humiliated. "The issue being addressed here is precisely undignified treatment," he said.
He also highlighted that the accused's lawyer acted with the "clear purpose" of disqualifying the victim.
"He showed personal and professional photos of Mariana, saying that some positions would be gynecological," he added.
Defense
Lawyer Dora Cavalcanti, representing the accused, defended the maintenance of the acquittal.
"It would be impossible to overcome the reasons that led to the acquittal of the defendant in the first instance, with the request for acquittal presented by the Public Prosecutor's Office, in the face of a body of evidence built not only in the investigation phase, but throughout an in-depth and careful evidentiary investigation, which made it impossible to support the complaint's thesis", he stated.

After the episode, in November 2021, Law 14,245 was published, which provides punishment for acts against the dignity of victims of sexual violence and witnesses during interrogations.
In 2024, the STF also established a ban on the disqualification of victims of sexual crimes in court hearings and police interrogations.
