DPU defends acquittal of Eduardo Bolsonaro in the tariff process

The defender's statement took place during the trial at the Federal Supreme Court (STF) of the criminal action in which Eduardo is a defendant for articulating the United States' tariffs on Brazilian exports. The case is analyzed by the First Panel of the Court.

According to the Attorney General's Office's indictment, Eduardo encouraged the United States to enact, last year, tariffs against Brazilian exports, the revocation of visas of ministers of the Court and the federal government and the application of the economic sanctions of the Magnitsky Act to try to avoid the conviction of former president Jair Bolsonaro in the coup plot process.
During the argument, the defender said that Eduardo had no interference in the enactment of President Donald Trump's measures against Brazil. According to Esdras, Eduardo carried out "political dialogue".
"Eduardo had no decision-making power over the foreign policy of the United States, he is not a member of the North American government and does not hold a public role in that country," he stated.

Esdras Carvalho also defended the impediment of Minister Alexandre de Moraes, rapporteur of the case, from participating in the trial.
For the defender, the minister was a victim of visa cancellation and Magnitsky Law sanctions.
"If the judge is impeded, he could not even exercise the jurisdiction to say that he would not be [impeded]," he stated.
Notification
The defender also argued that Eduardo Bolsonaro should have been notified to present a defense through a letter rogatory, a legal instrument for notifying people abroad.
"The defendant's right to formally know the accusation that is being made was taken away, even though it is said that, through social media, he already knows the reasons. It doesn't matter if he knows through other means," he stated.
During the process, the STF ordered the notification of the former deputy by notice, but he was not found nor appointed a private lawyer.
After the DPU's statement, the floor was given to Minister Alexandre de Moraes, rapporteur of the case, who will vote for the conviction or acquittal of the former deputy.
The remaining votes will be given by ministers Cristiano Zanin, Cármen Lúcia and the president of the collegiate, Flávio Dino.
Since last year, Eduardo Bolsonaro has been in the United States and had his mandate as a parliamentarian revoked for missing sessions of the Chamber of Deputies.
