The Court of Cassation of Rome, the highest appeals court in Italy, published the full decision in which it denied the extradition to Brazil of former deputy Carla Zambelli, sentenced to 10 years in prison by the Federal Supreme Court (STF).  The Italian decision concerns the extradition request made by Brazil regarding the case of hacking into the electronic systems of the National Justice Council (CNJ), a crime for which she was found guilty by the First Panel of the Supreme Court last year.  Related news: Justiça manda prender jornalista perseguido por Carla Zambelli . For the Italian Justice, there are “several elements” that raise doubts about the impartiality of Minister Alexandre de Moraes, rapporteur of the case at the Supreme Court. Isso porque ele ocupou diferentes papéis ao longo do processo, sendo, além de juiz, o prejudicado pelo ato considerado criminoso.  The Italian decision states that there is “insufficiency and illogicality in the reasoning in relation to the accumulation of the functions of victim, judge of first instance, judge of second instance and judge of execution in the person of M.A.D.M. [Minister Alexandre de Moraes]”. The Court of Cassation concluded that Moraes acted, in this specific case, “in violation of the principle of impartiality and independence of the judge”.  Shortly before the conviction became final, Zambelli fled, in July last year, to the United States and then to Italy, the country of which he has citizenship. She was arrested in the European country to await the judgment of the extradition request made by Brazil, but ended up being released in May this year, after the decision that rejected the procedure.  There is still, however, a second extradition request being processed in the Italian Court, awaiting a decision from the Italian Court of Cassation.  This case concerns the conviction of the former deputy for illegal possession of a firearm and illegal restraint in the episode in which she pulled out a revolver and chased a journalist through the streets of São Paulo, in 2022.  Responding to this, the Federal Supreme Court or the office of Minister Alexandre de Moraes have not yet commented on the decision of the Italian Court.
