Failure to pay the toll constitutes a serious infraction, with a fine of R$ 195.23 and five points on the driver's license. Resolution No. 277/2026 of the National Traffic Council (Contran) establishes a transition regime for the consolidation of the model in Brazil. The measure gives drivers up to 200 days to pay off electronic toll debts and suspends the application of fines in the free flow system during this period. How to appeal the electronic toll fine In the case of a freeflow fine, the user must file an appeal, prove that they have paid the toll and request a refund of the fine. In the case of free flow, the fine has already been applied and the driver needs to explain this in the appeal. This first defense must be analyzed by the authorities within 30 days. If the appeal is rejected, there is a period of 30 days to appeal in the first instance to the Administrative Infraction Appeals Board (Jari). The body has another month to issue its opinion. If this step is rejected, it is possible to appeal to the State Traffic Council (Cetran) in the second instance.
