The Attorney General's Office (PGR) sent this Tuesday (16) to the Federal Supreme Court (STF) an opinion against the request for a criminal review by former president Jair Bolsonaro to annul the sentence to 27 years and three months in prison in the coup plot process. In the document, the Attorney General of the Republic, Paulo Gonet, states that the case has already been closed and that no new facts were presented by the former president's defense to justify changes in the conviction.  Related news: STF condemns Eduardo Bolsonaro to ineligibility and 4 years in prison. The execution of the sentence imposed on Jair Messias Bolsonaro was determined and maintained by the Supreme Court, after a thorough assessment of the defensive arguments," said Gonet.  The prosecutor added that there is no relevant reason to reduce Bolsonaro's sentence.  "The theses raised by the author at the beginning of this revisional action did not bring any novelty to legitimize the deconstruction of the definitive jurisdictional pronouncement, either due to contradiction with the express text of the criminal law or the evidence in the case, or because it was based on testimonies, examinations or documents that were proven to be false or, even, due to the discovery of new evidence", he added.  Understand  On May 8, Bolsonaro's defense filed a criminal review with the Supreme Court and argued that the conviction should be reviewed because there was a “judicial error”. In the appeal, the defense challenged the conduct of the process that condemned the former president. For lawyers, as he is a former president, Bolsonaro should have been judged by the Court's plenary, and not by the First Panel. The lawyers also stated that the denunciation of Bolsonaro's former aide-de-camp, Mauro Cid, was not voluntary and should be annulled. The lack of full access to the investigation evidence was also raised. On the merits, the defense added that no evidence was indicated of Bolsonaro's participation in the coup acts of January 8, 2023 and in leading a plan to plan a coup d'état.   Last year, Bolsonaro was condemned by the First Panel of the Court, formed by ministers Alexandre de Moraes, Flávio Dino, Cristiano Zanin and Cármen Lúcia. As determined by the Supreme Court's internal regulations, the criminal review must be judged by the Second Panel, composed of André Mendonça and Nunes Marques, both appointed by Bolsonaro, in addition to Gilmar Mendes, Dias Toffoli and Luiz Fux. The case rapporteur is Nunes Marques. There is no deadline for judging the review.  Bolsonaro is currently under temporary house arrest for health reasons.
