The case will be judged this Tuesday (16) by the First Panel of the court, which is made up of ministers Flávio Dino, Cristiano Zanin, Cármen Lúcia, in addition to Moraes, rapporteur of the case.

The postponement was requested by the Federal Public Defender's Office (DPU), a body that works to defend the former parliamentarian.
Among the arguments presented, the body claimed that the group has had four of the five ministers since Luiz Fux's transfer to the Second Panel last year. For the DPU, a minister must be summoned to take part in the trial.
When denying the request for postponement, Moraes said that the Court's internal regulations defined that groups can operate with a minimum quorum of three ministers.
"There is, therefore, no violation of the principles of natural justice and collegiality in the judgment of this criminal action, in broad compliance with constitutional principles, the Internal Regulations of this Federal Supreme Court and procedural rules", stated Moraes.

In November last year, the STF accepted a complaint from the Attorney General's Office (PGR) in the investigation that investigated Eduardo Bolsonaro's actions with the United States government to promote tariffs against Brazilian exports, the suspension of visas of federal government ministers and court ministers.
Since last year, Eduardo Bolsonaro has been in the United States and lost his parliamentary mandate for missing sessions of the Chamber of Deputies.
Before releasing the case for trial, Alexandre de Moraes ordered the former deputy to be notified by notice, but he was neither found nor appointed a private lawyer.
Given the situation, the minister authorized the defense to be carried out by the DPU.
In the final arguments presented to the Supreme Court, the body defended the annulment of the process and said that Moraes cannot judge the case as he may have been a victim of visa cancellation and financial sanctions arising from the Magnitsky Law.
“Here the judge is, at the same time, the main victim of the conduct he is called to judge”, said the DPU.
