The Court ordered the City of São Luís to vacate and demolish irregular constructions that completely block traffic on a street in the Jardim Atlântico Subdivision, in the Turu neighborhood. The municipality will also have to pay R$50,000 in compensation for collective moral damages due to the lack of supervision.

The decision responds to a request from the Public Ministry of Maranhão (MP-MA). According to the process, photo reports carried out by the Municipal Department of Urbanism and Housing (Semurh) proved that Rua G between 8th and C streets was closed by walls and private buildings.
The city hall report highlighted that the invasion of the street did not occur due to social vulnerability (families without housing). The public space was taken over for commercial and private purposes, housing companies, unoccupied land and even a nightclub.
During the process, the inspection body Blitz Urbana confirmed that the problem occurred due to a lack of control by the municipality, which did not follow the project to divide lots in the region.
In the sentence, judge Douglas de Melo Martins, from the Court of Diffuse and Collective Interests, pointed out that the city hall was negligent in remaining inactive for years, creating a "vacuum of control conducive to urban disorder", even though it was aware of the irregular occupation.
To resolve the problem and reopen the street to the community, the Court established the following deadlines for the city hall to meet:
Within 90 days: identify all current occupants of the street;
Within 180 days (after the previous deadline): notify those responsible to vacate the area voluntarily;
After vacating: demolish all irregular constructions and remove rubble.
The compensation amount of R$50,000 will be allocated to the State Fund for the Protection of Diffuse Rights.
