Yesterday (8), the president of the TSE, Kassio Nunes Marques, suspended the publication of the survey and understood that the research induced voters' responses.
The survey was released on May 19 and showed a five-point drop in voting intentions for senator Flávio Bolsonaro (PL-RJ), pre-candidate for president, after the parliamentarian's conversation with banker Daniel Vorcaro emerged.
The minister responded to the suspension request made by the PL. The party questioned questions related to the Master case and said that voters were also shown the audio in which Flávio appears asking Vorcaro for money to finance the film Dark Horse, a biopic of former president Jair Bolsonaro.
With Kassio's individual decision, the research cannot remain published on the company's official channels, be republished or promoted on social media.
Plenary
In today's session, the TSE plenary began to decide whether the president's decision will be endorsed.
When reaffirming his vote, Kassio said that there are consistent elements for the possible "compromise of the methodological neutrality" of the questionnaire submitted to voters and that they cited the Master case.
"The existence of a sequence of questions that, at least in summary judgment, appear to go beyond the simple neutral measurement of public opinion to introduce narrative stimuli possibly capable of influencing the answers", he stated.
After the rapporteur's vote, Minister Estela Aranha requested a review and the trial was suspended.
Defenses
Lawyer Gualter Rafael Maciel Bezerra, representative of AtlasIntel, stated that the PL did not indicate a violation of the rules for carrying out electoral research and subjectively stated that Flávio was harmed.
"What we have in the representation is a disagreement in the methodology in relation to a public and notorious political fact, namely, the relationship between Flávio Bolsonaro, pre-candidate for the PL, with Daniel Vorcaro and the issue of Banco Master", he stated.
Lawyer Maria Claudia Bucchianeri defended the PL and said that the interest in disseminating "integrity research" is non-partisan.
"This research has a fatal problem, it did not include the full questionnaire, because it included a video, which it submitted to interviewees, but this media was not attached, it was not even transcribed", he claimed.
Audio and video
During the trial, Minister Dias Toffoli asked for an aside to question whether a research institute can show an audio or video when asking voters questions.
"Can you make a video? We know what will happen, there will be video for everything, and research that shows that video and then asks the question. Given this video, you would vote for A, B or C, you would vote for this or that one. There will be a video even citing judges. Let's not be naive", he stated.
The minister also said that the decision that will be taken by the TSE will set parameters for the dissemination of voting intention surveys for the October elections.
"We will decide the future. Research can do everything or nothing, or it can ask clear and objective questions, without inducement. And what would be this limit of what is inducement or what is not inducement", he added.
