Failure to comply with the quota policy in medical residency programs led the Federal Public Ministry (MPF) to file a public civil action so that the Hospital Israelita Albert Einstein, in São Paulo, implements the affirmative action policy. Prosecutors are asking for additional notices to be opened during the current selection process, from 2026, with the allocation of vacancies to candidates with disabilities, black people, indigenous people, quilombolas and trans people, according to the percentages defined by current regulations. "For the MPF, the application of the quota policy is essential to guarantee equal opportunities for these candidates, so that the composition of the body of resident doctors effectively represents the ethnic and sociocultural plurality of Brazilian society", highlights the Federal Public Ministry in a note. The Federal Public Ministry points out that, according to the most recent data, black people represent the majority of the population, but occupy only 27.5% of residency vacancies at the institution. On the other hand, 70.1% of resident doctors are self-declared white. The body emphasizes that "the application of affirmative actions in medical residencies is mandatory, even in institutions governed by private law", as the programs involve in-service training within the scope of the Unified Health System (SUS), in accordance with federal government regulations from 2025. "However, in the 2026 selection process, Sociedade Beneficente Israelita Brasileira Hospital Albert Einstein chose not to reserve places for ethnic-racial minorities and vulnerable groups, disrespecting the rules established by the Ministry of Health (MS)", says the note. The MPF recalls that Albert Einstein "is subsidized by indirect public resources, as it benefits from significant tax exemption, in the form of federal tax immunity", according to the document signed by Public Prosecutor Ana Letícia Absy. The hospital is exempt from collecting federal contributions, such as those allocated to social security. “The enjoyment of tax benefits and the use of public resources confer on the entity related positive obligations, which include the adoption of concrete measures aimed at promoting material equality and reducing historical inequalities”, states the prosecutor. In April of this year, the MPF had already taken a stand for the mandatory reservation of places in competitions for medical residency. Technical Note PFDC nº 10/2026, from the Federal Attorney's Office for Citizens' Rights, concluded that the application of quotas "in these cases does not constitute a mere administrative discretion of the educational institution". In a note sent to Agência Brasil, Hospital Albert Einstein stated that, to date, it has not been cited regarding the action, therefore, it has no knowledge of the content of the process.
