The panel's argument, the Brazilian Center for Research in Assessment and Selection and Promotion of Events (Cebraspe), was that she had "light skin, straight hair and fine features" — that is, characteristics incompatible with racial self-declaration. The candidate even filed an appeal, but it was rejected by the panel. So, she went to Federal Court, presented documentation, academic records and photographic evidence; The court recognized the inconsistency of the panel's decision, guaranteeing Flávia's return to the competition during all stages of the process. Based on this decision, she passed the training course and took office at Itamaraty; However, when Flávia's case went to the second instance, a judge understood that she could not have taken the position, since the first decision only spoke about her remaining in the competition, and not specifically about taking office; Because of this, the judge of the Federal Regional Court of the 1st Region (TRF1) annulled the previous decision that had given Flávia the right to continue in the contest. As she had already taken office, her dismissal was published in the Official Gazette of the Union (DOU), on May 22nd.
