Deolane Bezerra was the target of an operation by the Public Ministry of São Paulo and the Civil Police against money laundering by the Primeiro Comando da Capital (PCC). The influencer is suspected of money laundering, association with drug trafficking and being part of a criminal faction. The decision was handed down this Tuesday (9) by judge Deyvison Heberth dos Reis, from the 3rd President Venceslau Court, within the scope of Operation Vérnix. Deolane's defense, who is a lawyer registered with the Brazilian Bar Association (OAB-SP), stated that she has been preventively detained since May 21, 2026 at the Tupi Paulista Penal Complex and claimed that the place of custody does not have characteristics compatible with a General Staff Room. The defense also alleged that Deolane suffers from panic syndrome, uses controlled medication and had episodes of low blood pressure and dizziness due to prison conditions and the difficulty in eating adequately. The lawyers also cited the existence of scorpions in the cell, a strong paint odor resulting from recent painting and the need for medical attention. When analyzing the case, the judge considered information provided by the Tupi Paulista Women's Penitentiary, according to which Deolane has been held since May 22, 2026 in a Special Pavilion of the unit, separate from the other wings of the penitentiary. According to the prison administration, the site has individual rooms equipped with a bed, table, chair, bathroom with electric shower, fan, television, cold water and thermos, as well as a solarium for daily sunbathing. The unit also reported that it offers medical, psychological and dental care, visits in a private environment and periodic supply of personal hygiene kits. The penitentiary also denied the allegations of unsanitary conditions and scorpion infestation, stating that it carries out periodic pest control and ongoing maintenance of the facilities. In the decision, the magistrate stated that the place meets the professional prerogative guaranteed by the Law Statute and that Deolane is in a special cell, separate from the other prisoners. The judge also highlighted that there is no specific concept of a General Staff Room in the legislation and cited precedents from the Superior Court of Justice (STJ) and the Court of Justice of São Paulo (TJ-SP) according to which a special cell with adequate conditions can meet this requirement. When denying the replacement of preventive detention with house arrest, the judge noted that the request had already been analyzed previously and noted that the defense's attempts at the Federal Supreme Court (STF) and the São Paulo Court of Justice had also been unsuccessful. "Therefore, the requests made by the noble defense of the custodial Deolane, although respectful and well-founded, cannot be accepted. Having said that, I reject the requests made in your defense for the transfer of Deolane Bezerra Santos to the General Staff Room; as well as the replacement of preventive detention in a prison establishment with house arrest.", wrote the judge. Request for freedom STJ denies Deolane Bezerra's request for freedom in Tupi Paulista The Fifth Panel of the Superior Court of Justice (STJ) denied on Tuesday (9) a request for freedom from Deolane Bezerra, a digital influencer and lawyer who has been in pre-trial detention since May 21. Ministers Ribeiro Dantas, Joel Ilan Paciornik, Maria Marluce Caldas and Messod Azulay Neto understood that it is not appropriate for the STJ to intervene at this time because other requests for freedom for the influencer are pending analysis in lower court courts. Deolane's lawyers argued to the STJ that the case does not meet the legal requirements for preventive detention. They claimed that there would be no concrete risk to public order, criminal investigation or the application of criminal law and that the evidence gathered is already in the possession of the authorities. The ministers recommended that the São Paulo Court of Justice speed up the analysis of the influencer's defense appeals. The defense also pointed out that: preventive detention should be replaced by home detention because Deolane is the mother of a 9-year-old child, being the only one responsible for their care; the grounds for the arrest were generic and did not individualize the reiteration of the crime, destruction of evidence or escape, without indicating current concrete facts. The facts investigated are from 2018 to 2021; other precautionary measures are appropriate and sufficient in the case, such as surrender of the passport, prohibition of leaving the city and prohibition of contact with those being investigated. Police report indicates that Deolane transferred R$13.6 million between 2018 and 2022 in his personal accounts, while another R$14 million passed through three of his companies. For investigators, the origin of the resources is "spurious" and shell companies were identified in the name of the influencer, located in cities in the interior of São Paulo, close to the Presidente Venceslau prison, sharing the same address with dozens of other shell firms. The influencer's defense denies any type of involvement with organized crime or illicit money, stating that all her receipts are declared and justified. Minister Ribeiro Dantas, rapporteur of the case, highlighted the seriousness of the facts and said that, despite her being the mother of a child under 12 years old, this does not automatically guarantee freedom or house arrest. Ribeiro Dantas stated that the decision that authorized the arrest is duly substantiated and there are no elements that justify a review, at this time by the STJ, which must await analysis by the responsible bodies. "The favorable personal conditions, alleged absence of risk of escape and spontaneous return to Brazil, are not sufficient to rule out sufficient elements to eliminate the need for custody when objective elements are present that recommend maintenance or authorization for replacement by alternative measures in a context of organized action and risk of reiteration", he stated. During the trial, the influencer's lawyer, Aury Lopes Jr, stated that the elements do not justify the arrest and that there was a media arrest and asked that Deolane remain free. The lawyer stated that she was investigated exhaustively over four years, but between 2022 and 2024 there was no statement from the Public Prosecutor's Office in the case nor a request for her to provide clarification.
