Newborn falls during birth and hospital is condemned The Minas Gerais Court ordered Sofia Feldman Hospital to compensate R$175,000 to the family of a baby who suffered head trauma when she fell to the floor during childbirth, at the unit's reception, in 2022 (remember the case in the video above). The decision was taken by judge Moema Miranda Gonçalves, from the 8th Civil Court of the District of Belo Horizonte. According to the process, the pregnant woman arrived at the maternity ward about to give birth. However, after an initial screening, she was classified as a "green" risk patient and advised to wait. Even with the increase in pain and contractions, the woman was not re-evaluated by the medical team and, about an hour later, her daughter was born in an inappropriate place and suffered a fall (read more below). ✅ Click here to follow the g1 Minas channel on WhatsApp In addition to compensation, the health unit must reimburse, as material damages, the cost of all treatments for the child as a result of the episode and psychological support for the parents upon presentation of reports and proof of expenses. The decision is of first instance and can be appealed. When contacted by g1 for a position, Sofia Feldman Hospital said that the patient was not a victim of lack of assistance and that the statement that the pregnant woman was not re-evaluated is unfounded. "Sofia Feldman Hospital informs that it will file the appropriate appeals against the aforementioned decision, as it understands that it was made in clear contradiction to the body of evidence produced during the procedural investigation, including the content of the expert report itself", informed the institution. Baby suffered head trauma after being born in BH Personal file Parents sought justice The baby's parents went to court alleging that, on May 6, 2022, the mother, in labor, arrived at the maternity ward in the morning and, after an initial screening, was classified as a "green" risk and advised to wait. However, even with the increase in pain and signs of labor progress, there was no reassessment of her condition. An hour after being admitted to the unit, in the hospital reception itself, the child was born unassisted, falling to the floor and suffering a head injury, requiring emergency surgery. Security cameras filmed the incident (see video below). In the process, the hospital claimed, in its defense, that it was an event of an unpredictable nature, that assistance was provided in accordance with protocols and that the initial risk classification was correct. Furthermore, he maintained that, at the time of birth, four professionals were assisting the patient, but a "fortuitous case" occurred, with no causal link. Video shows moment that baby falls after birth at maternity reception in BH Conviction In the sentence, judge Moema Miranda Gonçalves argued that the technical evidence added to the process, such as reports, images from the unit's security camera and medical records, left no doubt about the failure in the initial screening, as the nursing team omitted to record an essential parameter, the frequency and rhythm of contractions, as well as the lack of timely reassessment of the patient. "The patient remained at the reception for almost an hour, showing clear signs of progression of labor (antalgic posture, restlessness, trips to the bathroom) [...]. Furthermore, the failure in reclassification was demonstrated when the author finally requested help, the correct classification of which would be 'red', which requires immediate emergency care, as well as the lack of adequate assistance during childbirth [...]", maintained the judge. The judge also pointed out that, once a pregnant woman in labor enters the hospital unit, it is the duty of the responsible public entity to ensure efficient monitoring, adequate risk classification, continuous monitoring of the evolution of the obstetric condition and timely adoption of the necessary measures to guarantee maternal-fetal safety. "It is not compatible with the postulates of the Democratic Rule of Law to admit that a pregnant woman seeks hospital care in the context of labor, trusting in the adequate provision of health services, and, due to the manifest deficiency in care, gives birth in an inappropriate place, without the technical support required by the circumstances, culminating in the newborn falling shortly after birth and the occurrence of serious head trauma [...]", stated the judge.
