Jair Bolsonaro's defense confirmed this Tuesday (17) to the Federal Supreme Court (STF) that the former president is the owner of the firearm that was seized from one of his security guards during a blitz by the Military Police of the Federal District (PMDF). The statement was sent to the Court after Minister Alexandre de Moraes, rapporteur of the case, ordered the defense to clarify the episode. In the document, the lawyers stated that the weapon is regularly registered in Bolsonaro's name and has a Firearm Registration Certificate (Craf). According to the defense, the former president, who is under house arrest, asked Army second sergeant Estácio Leite da Silva Filho, who is part of his private team and was stopped during the blitz, to take the weapons for repairs. The lawyers stated that Bolsonaro found that the weapon was not fully functional.  "Recently, the petitioner found, by simply activating the bolt, without any need for firing, that the mechanism was not working regularly," said the defense. The lawyers also stated that the possession of breastfeeding has no relation to the end of the 90-day period for ending house arrest and that Moraes did not order the seizure of weapons during the course of the coup plot process, in which Bolsonaro was sentenced to 27 years in prison. "It is also noted that, despite the conviction imposed in AP 2668, the surrender of weapons, cancellation of registrations or any similar measure was not determined. The petitioner, therefore, was not in an irregular situation", concluded the defense. >> Follow the Agência Brasil channel on WhatsApp Seizure The weapon was seized at 11:30 pm last Monday (15), when a Honda Civic was stopped at a roadblock in Pitão Norte, in Taguatinga. During the approach, the driver identified himself as a member of the Institutional Security Office of the Presidency of the Republic (GSI) and said that the weapon belonged to the former president. During the raid, a spare pistol magazine, a Glock 9 millimeter (mm) model, was also located. The driver was taken to a police station, where he stated that the weapon was given to him due to a breakdown. In his statement, he also reported that he removed the pistol on the 15th in order to carry out the repair and that the weapon would be returned the following day. >> Follow the Agência Brasil channel on WhatsApp Remedies Bolsonaro's defense also stated that the weapon was removed from the former president's possession after the electronic ankle bracelet broke last year. "Although he regularly possessed the weapon, the psychiatric medications that were being administered to the petitioner, capable of affecting his cognition — and which were even decisive in the episode of the electronic ankle bracelet breaking — led his security team, without his prior knowledge, to remove the firing pin from the weapon, rendering it inoperative," he added.
