Baby is admitted to a health unit dead and with signs of beating and abuse in Sorocaba Reproduction Communication failure Counselors, who preferred not to identify themselves, claiming to have suffered threats after the repercussions of the case, confirmed receipt of the alert sent by the health unit, but explained that there was a communication error. According to the council, the notification arrived by email, a procedure that, according to sources in the area, is standard and sufficient to begin the investigation. However, in the counselors' version, the electronic message did not indicate that it was an urgent case. One of the counselors stated that the hospital should have contacted the Military Police and the Legal Medical Institute (IML), in addition to making a telephone call to the Council. According to her, if there had been a call, the team would have asked for the child to be kept in the health unit. "What happened? This situation of neglect of hygiene and care arrived. Of child care. There is no mention of sexual abuse in this document", he begins. "When the hospital identifies this, it is the hospital itself that has to take the necessary measures by referring the child to room 60, to the IML. The Guardianship Council is not a body that will be able to detect whether the child is suffering any sexual violence. The other type of flow that can happen, and should happen, is the telephone call. We always receive a telephone call. In this case, we were very surprised", claims the counselor. And we would certainly ask for this child to be held in the hospital", he added. The council claims that the case came solely as "neglect of hygiene and care". However, the email sent by the health unit asked for "awareness and monitoring of the case" and detailed a serious situation. According to the medical document, the child had: Pain, swelling and secretion in the intimate region; Irritation in the anal region; Lack of basic items (the mother did not bring a diaper or change of clothes); Inadequate feeding (the baby was fed with milk diluted with water). Even with the seriousness of the report, the Guardianship Council's assistance was terminated the following day. A counselor went to the family's home, but the mother did not allow her entry. The contact occurred at the gate, with the child on his lap. The team verbally warned the woman about hygiene care and closed the case, without checking at Basic Health Units (UBSs) or care centers whether the baby continued to receive medical treatment. The police report states that a doctor fell ill when she saw the marks of violence on the child's body. In the house where Miguel lived with his mother and stepfather, forensics found traces of blood in several rooms. Relatives told the police that they saw bruises on the baby, but the mother claimed that the marks were caused by her son. Mother and stepfather are in pre-trial detention. Gabrielly Franco Garcia is in the Votorantim Women's Penitentiary, and Rafael Luis Alves Júnior in Sorocaba Penitentiary 2. The President of the Children's Rights Commission of the OAB of Sorocaba understands that there were failures in monitoring the case. The lawyer also states that the mother's refusal to allow counselors to enter the residence should not have ended the proceedings.
