“The presidency of the Federal Supreme Court follows with concern the recent decision handed down by the Italian court on matters related to legal cooperation between the two countries, highlighting that this Court has been acting with marked deference to foreign States when examining extradition requests,” he said.
The president also defended the performance of STF minister Alexandre de Moraes.
"In the case in question, a complaint was filed by the Attorney General's Office for committing crimes of hacking into a computer device and ideological falsehood. The complaint was received unanimously by the First Panel, which endorsed the monocratic decisions of the eminent rapporteur, Minister Alexandre de Moraes", he added.
Sentence
On May 22, the Italian court, the last instance in that country, rejected the Brazilian government's request to extradite the former parliamentarian. After the decision, Zambelli was released and awaits the outcome of the process in Italy.

The Italian magistrates pointed out the partiality of minister Alexandre de Moraes in judging the case. According to the sentence, Moraes acted as “judge and victim” when acting as rapporteur of the criminal action that condemned Zambelli.
She was sentenced by the First Panel of the Supreme Court to 10 years in prison for the invasion of the electronic system of the National Justice Council (CNJ), which occurred in 2023.
According to investigations, Zambelli was the mastermind behind the invasion to issue a false arrest warrant against the minister.
Before the sentence was carried out, Zambelli fled to Italy, and the Brazilian government requested his extradition. She has dual citizenship.

Zambelli's extradition is the second to be rejected after a request from Moraes' Brazilian government.
In December last year, the Spanish Court definitively denied the Brazilian government's request to extradite blogger Oswaldo Eustáquio, investigated by the STF on charges of involvement in undemocratic acts.
According to the Spanish court's decision, Eustáquio cannot be sent to Brazil because he is the target of a "politically motivated" investigation. The case is also reported by the minister.
The blogger had an outstanding arrest warrant in Brazil since 2020 and fled to the European country amid investigations that revealed the suspicion that he acted to promote extremist attacks against the STF and Congress through social media.
