The decision was taken by the Jury Court this Friday (12), after the second day of trial at the Barro Duro Forum, in the upper part of the capital of Alagoas.
The defendant responded to the case at liberty. After the sentence, judge Geraldo Amorim ordered the sentence to be served in a common maximum security prison. Because he was expelled from the corporation, Gilmar will not have the right to serve a sentence in a military unit.

"If he had gone to reserve or retirement, he would have gone to the military prison, but as he was expelled, he will go to a common prison. Away from the other prisoners, especially because, in any case, you are a former military police officer", stated the magistrate when announcing the conviction.

The case went to trial almost 27 years after the crime. Sergeant Osmário was kidnapped at the door of his house, in front of his daughter, who was 4 years old at the time.
The soldier's daughter, Cinara, now a lawyer, acted as an assistant prosecutor in the trial. In one of the moments of the session, she spoke directly to the jurors.
"I talk to my father every day. The defendant has a daughter my age and I would like to know what it's like to have a father. It doesn't comfort me to be here, because my father won't be back," he said.
Cinara also recalled the period in which she lived under police escort after the murder. "I had two police officers with me 24 hours a day to protect me and I asked them to play with me, because I didn't have my father," he said.

Assistant prosecutor Thiago Cavalcante highlighted that the family lived in constant fear. "I followed her traumas, her fear of leaving the house, of going to the cinema, to a shopping mall. She grew up suffering. He killed her whole family," said the lawyer.
'The dead man has no lawyer'
During the debates, prosecutor Adilza de Freitas highlighted Cinara's participation in the accusation and stated that it was up to the jurors to give society an answer.
"Take the weight off your shoulders. If we are here today it is because there is someone to blame," said the prosecutor. “The dead man does not have a lawyer, he cannot speak, cry, present his version of the facts.”

The prosecution highlighted that the sergeant's widow, Nair, recognized the defendant and ruled out the involvement of another suspect. According to the prosecution, after drawing up a sketch, the widow recognized Gilmar when she saw him among other people.
Still during the reply, the prosecution stated that the defense requested the postponement of the trial on 12 occasions over the years — the last request had been made in April of this year.
At the end of the debates, the jurors accepted the thesis presented by the Public Ministry and condemned the former PM corporal.
