The Superior Court of Justice (STJ) annulled the trial that sentenced Junio Cesar Roza Giorgetti to 30 years in prison for the death of his girlfriend Vanessa Nobre Martins, in Sertãozinho (SP). The 19-year-old girl was murdered in 2013. The Public Ministry said it will appeal.
The decision to revoke the sentence given in 2023 by the jury court was made by the reporting minister Ribeiro Dantas after an appeal by Junio Cesar's defense.
In the document issued on June 9, the minister argued that no concrete evidence of authorship of the crime was found.
Ribeiro Dantas also welcomed a statement from the Public Prosecutor's Office, which stated that the investigations did not produce any element of conviction against the defendant. Finally, the minister mentioned that, at the time of the crime, a third party confessed to the crime to the Municipal Civil Guard (GCM), but ended up killing himself afterwards. The fact ended up increasing uncertainty about the perpetrator of the homicide.
“No witness actually saw the facts, nor is there any objective evidence to demonstrate the criminal authorship, beyond confirming the conflictual relationship between the appellant [Junio Cesar] and the victim.”

With this, Ribeiro Dantas ordered that Junio Cesar be brought to a new trial. There is no date yet for the jury trial.
In 2013, Junio Cesar obtained a habeas corpus in court. He was free until 2023, when the jury convicted him and he returned to prison.
The STJ's decision should release Junio Cesar in the coming days.

Homicide in 2013
Vanessa was found dead on the afternoon of September 30, 2013. According to the Military Police, the body was seen in a stream in Cohab III by residents of the region and was recognized by family members ten days after the young woman was considered missing.
During this period, relatives and friends even resorted to using a sound car and the help of authorities to try to find the young woman.
The report from the Legal Medical Institute (IML) indicated that Vanessa was asphyxiated and her body was mutilated, before being thrown into the stream.
Throughout the investigations, the Civil Police gathered evidence that the day before the disappearance, Giorgetti picked up the victim by car from the supermarket where she worked, around 7pm, and took her home. According to the investigation, the couple fought, and the boyfriend sent the girl away, around 9:30 pm.
A witness said that, before leaving the house, Vanessa said she was going to a concert hall. After that, she was never seen again.
The investigations led the police to conclude that Vanessa was violently attacked by Junio Cesar and had organs removed before being found in the stream.
