The minister's vote was given in the trial in which the Court analyzes companies' appeals against the decision that, in June last year, recognized the responsibility of big techs for illegal publications made by their users. He is one of the rapporteurs of the judged actions.

Toffoli voted to establish a time frame to apply the decision and grant a 60-day deadline for companies to implement the structural obligations defined in the judgment that recognized liability.
Among the measures, companies must prohibit users from accessing videos with:
sexual exploitation and abuse;
physical violence;
inducing behaviors that lead to harm to the physical or mental health of children or adolescents.
Furthermore, platforms are required to maintain a legal representative in the country to receive subpoenas from the courts.
"This is a period that I consider reasonable and more than sufficient to finalize the relevant measures and possible adjustments as a result of the clarifications provided," stated Toffoli.
The minister also decided to reaffirm that the defined rules apply to future cases. According to the understanding, the time frame for the decision to be effective must be June 27, 2025, when the trial minutes were published.
After the rapporteur's vote, the plenary began collecting the remaining votes. Nine more votes will be cast.
The STF judges appeals that request clarification on the Court's decision that established the networks' liability. The appeals were filed by Facebook and Google.
The platforms' resources ask for a deadline for implementing the rules defined during the trial or for the application of the rules to be guaranteed only after the plenary decision has become final.
