Martins was sentenced in 2021 by the Court to answer for qualified homicide, due to Silvinha's death, in addition to attempted murder against her husband, José da Silva, who was also injured in the accident.

José da Silva survived, but suffered serious injuries. For this reason, the police officer is also responsible for attempted murder. At the time, the widower said the PM was speeding.
The version is even included in the complaint presented by the MP-AC. An expert report showed that the vehicle was traveling at around 130 km/h in a section where the maximum speed allowed was 40 km/h.
Still according to the process, witnesses reported that the police officer had consumed 30 bottles of alcohol before driving, but the defense denied this version.
Previous conviction
Alan has already faced another popular jury. He was one of the defendants in the murder trial of Maria Cauane, aged 11, Gleiton Silva Borges and Edmilson Fernandes da Silva Sales, during a BOPE operation in Rio Branco, in 2018.
In December 2024, he and the other defendants were acquitted. In October last year, the court upheld the decision.
