The São Paulo Military Police published the order that formalizes the transfer to the reserves of lieutenant colonel Geraldo Leite Rosa Neto, arrested accused of the femicide of soldier Gisele Alves Santana and procedural fraud. In the military structure, the measure is equivalent to retirement. He has been in pre-trial detention since March 18th. Although this decision had already been announced in an ordinance, the act that made it official was only published in the Official Gazette of the State of São Paulo this Tuesday (9), with the signature of the director of Military Inactivity and Pension, Colonel Antonio Thomazelli Júnior. In the order, the lieutenant colonel accused of murder was officially transferred to the police reserve. On his social networks, lawyer Miguel José da Silva Junior, who defends soldier Gisele's family, said that he was surprised by “the PM's speed in retiring him”. For the lawyer, this decision demonstrates that the PM is “giving privileges” to the lieutenant colonel.  "This retirement will not stop the Justification Council, which will dismiss him. We are convinced of this. On the other hand, it is not fair that this citizen, who committed such a barbaric crime, continues to receive amounts at the expense of the population and even Gisele's parents, who pay his taxes", said the lawyer in a video published on his Instagram. Gisele was married to the lieutenant colonel and was found dead, with a gunshot to the head, on February 18, in the apartment where the couple lived, in the capital of São Paulo. The lieutenant colonel called for help and reported the case to authorities as a suicide. The record was later changed to suspicious death. Reports from the Legal Medical Institute (IML) confirmed signs of aggression incompatible with suicide. The victim's family has contested the suicide version since the incident was recorded. In a note, the Military Police informed that the transfer of the officer to the reserve “occurred in accordance with current legislation and does not prevent possible criminal or disciplinary liability”.
