Councilor Eduardo de Lara (Republicans), removed from office and investigated on suspicion of participating in a crack scheme in the Chamber of Iguape (SP), was sentenced to 33 years, one month and ten days in closed prison. According to this Tuesday's decision (9), the parliamentarian committed the crime of excessive exaction eight times.
🔎 Excessive exaction is provided for in article 316 of the Penal Code. The crime occurs when a public official uses his position to demand a charge that he knows is undue or when he uses abusive means to charge an amount that could be legally demanded.
The reporting team contacted the Iguape City Council and Eduardo de Lara's defense, but did not receive a response until the last update.

According to the complaint from the São Paulo Public Ministry (MP-SP), the parliamentarian was president of the Iguape City Council and demanded part of the salaries of commissioned employees as a condition for keeping them in their positions. The scheme, known as rachadinha, would have operated between 2021 and 2025, with values varying between R$1,500 and R$2,000 per employee.

Lara was also ordered to pay a 157-day fine and compensation of R$200,000 to the victims, in addition to the loss of his mandate after the decision became final. He can appeal the decision freely, as long as he complies with the following precautionary measures:
➡️Attend quarterly to inform and justify your activities;
➡️Keep the address updated with immediate communication of any changes;
➡️Prohibition of leaving the district for a period longer than eight days, without prior communication;
➡️Suspension of the exercise of the mandate, being prohibited from carrying out any activities related to the position.
Decision
As reported in the decision document, victims and witnesses reported that the councilor used his position not only to demand monthly payments, but also to threaten victims with consequences that went beyond the loss of the commissioned position.
According to reports, some threats were related to the granting of permits and other administrative acts dependent on Lara's influence. Given this, the decision considered that reinstatement to the mandate would represent a real risk to public order.

Messages
The MP-SP attached conversations between the councilor and commissioned employees that reinforced the suspicion of a split. In the messages, the parliamentarian defined how much each employee should return from their salary and organized a monthly payment system through intermediaries.
g1 had access to messages exchanged in 2022 in which a server complains to a friend that the amount demanded for her salary was higher than that of another colleague. In conversations, she claims to pass on R$2,000, while the employee handed over R$1,500 (see the screenshot at the top of the report).
