An event held on Tuesday night (9) on Avenida Paulista, in São Paulo, protested against a project approved last week by the plenary of the Federal Senate that suspended the validity of Resolution no. 258/2024 of the National Council for the Rights of Children and Adolescents (Conanda).  The measure guided the humanized care of children and adolescents victims of sexual violence and the guarantee of their rights, including legal abortion when the pregnancy is the result of rape.  Related news: Senate annuls rule on legal abortion for child victims of rape. The demonstration began around 6pm in front of the São Paulo Museum of Art (Masp) and went on a walk along Avenida Paulista to Praça do Ciclista. “The [Conanda] resolution does not create any new rights, but it reorganizes the flow of access to legal abortion for children and adolescents who are victims of sexual violence and who, as a result, become pregnant,” explained Dafne Sena, member of the State Front for the Legalization of Abortion. The rule that was annulled had been approved by Conanda in December 2024 and regulated the procedures already provided for in the Brazilian legal system for specific cases, such as pregnancy resulting from rape. "Conanda Resolution 258 avoided revictimization, that is, it prevented this child from experiencing other types of violence during the process of seeking a legal abortion. It tried to prevent a child from suffering other violence resulting from an already very large violence, which was sexual violence. This resolution organized this flow, it did not create any new hypothesis of legal abortion or new services. It only organized how this child's access [to this service] should be", said Dafne. Right guaranteed by law The event on Avenida Paulista was organized by the National Front against the Criminalization of Women and the Legalization of Abortion and is part of a national mobilization that aims to reinforce that legal abortion is a right guaranteed by law. Currently, legal abortion is only authorized in three situations, including in the case of pregnancy resulting from rape, which includes the rape of a vulnerable person (under 14 years of age). This right is also guaranteed in the case of a risky pregnancy for the woman and in the case of fetal anencephaly. "Today we already have a very serious situation, which is the prevention of abortion in several cities, even in cases of legal abortion. And this tends to get even worse now with PDL 3", said Tamires de Sousa Arantes, a member of Coletivo Juntas.  According to her, this Tuesday's act aims to emphasize that the right to abortion in cases of rape is already guaranteed to these children through the Constitution.  "Today we are on the streets to guarantee the rights of these children and in defense of childhood. This is a right that has been established for over 40 years. So, we are not even talking about advancing this right [to abortion]. We just cannot lose what we already have and which is currently threatened by the Senate and the extreme right", said Tamires. Victims  According to the National Map of Gender Violence, 64 girls are victims of sexual violence every day in Brazil. From 2011 to 2024, 308,077 girls up to the age of 17 suffered this type of violence in the country. The 2025 Brazilian Public Security Yearbook pointed out that, in 2024, Brazil recorded the highest number of rapes and rapes of vulnerable people in the historical series, with 87,545 occurrences in the period. Of the total number of incidents, more than half (76.8%) corresponded to the crime of rape of a vulnerable person.
