The defense of the adoptive mothers involved in the case that became known as "de-adoption" states that the decision to break the family bond came exclusively from the adopted son and denies that he was abandoned by the family.
The case gained repercussion after Flávio da Silva Maximiano Júnior questioned in court the sentence that ended his adoption when he was already of legal age. The young man seeks to reverse the decision and recover rights arising from adoptive parentage.
According to the lawyer representing Lilian Regina Terres Moroso and Sônia Moroso Terres, the two did not want the family relationship to break up and tried to convince Flávio to give up the idea.
"The mothers never agreed. The mothers begged, asked, cried, did everything to dissuade Flávio from this decision. But there was no way," said the lawyer in an interview with Fantástico.
Still according to the defense, the mothers' agreement with the request occurred because Flávio had already reached the age of majority and was determined to leave the family.
"An adult man made this decision and they had nothing to do," said the legal representative.
The lawyer maintains that the mothers felt their son's departure as a family loss.
"With that feeling of mothers who lost their child, they had to agree," he said.

Despite the ongoing legal dispute, the defense claims that the emotional bond was never broken on the part of the adoptive mothers.
Asked about the possibility of a rapprochement, the lawyer replied that Flávio would be welcomed back by the family.
“Absolutely,” he said. "Their hearts are those of mothers."

Case remains in court
Flávio challenges the sentence that canceled the adoption in court. Through his lawyer, he argues that the process took place without a hearing or psychosocial study and seeks the restoration of rights arising from adoptive affiliation.
The Public Ministry of Santa Catarina stated that the case created a type of "filial divorce", a situation not provided for in Brazilian legislation. The state Court of Justice reported that the matter is being dealt with at the administrative and judicial levels.
