The Supreme Court on Monday said that consensual physical relationship between two unmarried adults cannot be used as a basis for characterizing a person as bad. The court clearly said that there is no law which prevents two adult and unmarried people from having a relationship of their choice. The bench of Justice Manmohan and Justice Manoj Mishra made this comment while hearing a case of Telangana State Level Police Recruitment Board. The court accepted the appeal of the candidate whose police constable recruitment was cancelled. The court directed to appoint the candidate. The board had declared him ineligible for appointment. According to PTI, the candidate's appointment was canceled because a case of rape by promising marriage was registered against him in 2014. The recruitment board considered it a case of moral turpitude and disqualified him. The candidate had challenged this. However, this case was related to a failed love affair. As per records, the candidate and the complainant were neighbors and were in a relationship for about four years. Later, a settlement was reached between the two and the case was closed in Lok Adalat in 2015. No charges were pursued under section 376 of the IPC in the case.
