The mother of the boy Henry Borel, teacher Monique Medeiros, left the Talavera Bruce women's prison, in the Gericinó Penitentiary Complex, this Thursday afternoon (4), after receiving a judicial pardon from judge Elizabeth Louro, of the 2nd Jury Court. By decision of the Sentencing Council of the 2nd Jury Court of Rio, Monique had the crime downgraded from intentional homicide (with intent to kill) to manslaughter (when there is no intention to kill) and received a judicial pardon. She was sentenced to one year and four months in prison for the crime of omission in relation to the torture suffered by her son. The sentence, however, will be appealed by the Prosecutor's Office. "The sentence will be subject to appeal, since, in a first question, Monique was considered responsible for the intentional death of Henry. Therefore, we understand that she should also have been convicted of the intentional homicide", stated the prosecutor of Justice Fábio Vieira, who served on the jury. Justice condemned Jairinho and granted pardon to Monique - Photo: Brunno Dantas/TJRJ Henry's stepfather, former councilor Jairo Souza Santos Júnior, known as Dr. Jairinho, was sentenced to 43 years, nine months and 20 days in prison for the death of the 4-year-old boy, which occurred in March 2021. The former councilor was convicted of the crimes of double homicide, torture and coercion. Fábio Vieira highlighted, in his support to the jurors, that the former councilor had a history of attacks against women and children. As an example, he cited an episode mentioned by Monique herself during her interrogation, when she stated that “Jairo would have jumped over the wall of her house and hanged her out of jealousy”. Regarding Henry's mother, the prosecutor highlighted that she ignored several warning signs about the risk that Jairo posed to her and her son. “Monique, consciously and voluntarily, as the mother of the victim and legal guarantor of Henry Borel, omitted her responsibility, effectively contributing to the consummation of the crime of murder of her son, since, being aware of the attacks that the minor suffered from his stepfather and being present at the place and day of the events, she did nothing to prevent them or keep him away from the harmful relationship with the accused Jairo”, reported the prosecutor. Monique's defense Lawyers Florence Rosa and Hugo dos Santos Novais, who work in Monique's defense, highlighted that “the Jury Court constitutes one of the most important constitutional guarantees of the Democratic State of Law, with the sovereignty of verdicts being a principle expressly guaranteed by the Constitution of the Republic of 1988”. On a note, they assess that the trial was guided by the analysis of the evidence produced in the procedural instruction, within the rules that govern the popular jury procedure. Throughout the entire process, Monique's defense maintained that "she did not commit any aggression against her son and that her biggest mistake was failing to realize, in time, the violence that she and her son suffered. Henry's death represents an irreparable tragedy for everyone involved in this case." In the text, the defense says that the process also invites society to reflect on the need to evolve the understanding of phenomena related to domestic, psychological and gender violence, abusive relationships and the excessive exposure of women as victims, as they are not always able to immediately identify the signs of the violence to which they are subjected.
