According to the magistrate, Marco Aurélio already had a protective measure related to the same victim and had been formally notified of the court decision. "The dynamics of the facts reveal a typical situation of repeated domestic violence, inserted in the context of a previous intimate relationship, with a history of aggression and escalation of risk", wrote the judge. The decision also mentions that arrest is necessary to prevent new episodes of violence and guarantee the protection of the victim. The recordings show the suspect arriving at the beauty salon where Solange was. Minutes later, he appears leaving the place carrying the woman, apparently unconscious, in his arms. Witnesses noticed the situation and caught the attention of a Military Police vehicle that was passing along the street. Upon noticing the police officers approaching, Marco Aurélio abandoned the car and fled on foot. The victim was found unconscious in the back seat of the vehicle and taken to Odilon Behrens Hospital. The suspect was eventually located and arrested shortly after. According to his report to the police, the argument escalated into aggression. The man admitted to punching and kicking the victim and strangling her until she lost consciousness.
