According to the process, the guard prevented the entry of a vehicle driven by Laura's husband because the car was not among those authorized to access the hospital's internal parking lot, which caused a disagreement.
According to witnesses, the doctor referred to the professional with the phrase "Who does that arigó caboco think he is to approach me like that?", questioning the fact that the victim had called her by the pronoun you.
What was the penalty imposed?
The crime of racial insult is provided for in the Brazilian Penal Code and consists of offending someone's honor using elements relating to race, color, ethnicity, religion or origin.
However, if the conviction remains until the definitive end of the process, the doctor will not be imprisoned. The sentence was set at two years of open prison, with prison being replaced by two alternative measures: provision of services to the community and payment of a minimum wage.
The defense highlighted that Laura was acquitted in the first instance and maintains that the accusation is based on witness reports, with versions that they consider divergent throughout the process.
The lawyer also informed that the decision is not final and that the doctor will not serve any sentence at this time. According to him, the defense intends to appeal to the higher courts in search of a new review.
Case happened in 2024
The case occurred in February 2024, at Into, where the doctor worked. Laura arrived at the hospital accompanied by her husband and tried to drive the car into the unit.
The security guard informed that he could not allow entry because he had received instructions to only allow access to authorized and registered vehicles.
According to the process, the racist expression was repeated several times.
The guard stated that he felt humiliated and discriminated against by the speech, which he considered offensive because of his skin color. After the episode, he filed a police report.
