Furthermore, doctors did not prescribe the antiviral oseltamivir, a medication protocol recommended for pregnant women. The progression of the disease resulted in the death of the woman and her baby. The complaint offered by prosecutor Valéria Ferreira de Lima was accepted this Wednesday (10) by the Judiciary. The name of the hospital and doctors was not disclosed. How the case happened According to the complaint, the victim sought care five times within a few days at the private hospital, presenting persistent symptoms and progressive worsening of the clinical condition. As pointed out by the Public Prosecutor's Office (MP), despite the history of high-risk pregnancies due to sickle cell anemia, repeated visits and worsening laboratory tests, the accused failed to adopt therapeutic measures considered appropriate, opting to prescribe medication to alleviate symptoms and release the patient for home treatment. According to the accusation, the three doctors contributed, at different times, to the evolution of the woman's infectious condition by not recognizing the seriousness of the clinical situation and by failing to arrange for hospital admission and the initiation of treatment recommended by the Ministry of Health (MS) for pregnant women with flu-like syndrome. Expert reports produced during the investigation indicate that there is an intrinsic relationship between the doctors' omissions and the fatal outcome, due to the systemic inflammatory response syndrome resulting from influenza A infection, which is a subtype of the influenza virus that causes acute respiratory infections. "Serial blood counts carried out between February 3 and March 20, 2020, showed progressively chronic anemia, leukocytosis with neutrophilia and thrombocytosis — unequivocal laboratory signs of the presence of a progressive acute infectious process. These data were available in the care records and should have been evaluated by the doctors on duty who treated the victim on March 17, 18 and 19, 2020. They were not", stated in the complaint. Trending videos on g1 What are the possible punishments In addition to asking that the accused be arrested or receive criminal punishment, the Public Prosecutor's Office asked the Court to define a monetary amount to compensate for the moral damage caused by the crime. The request asks the defendants to pay: R$150,000 to the victim’s husband (widower); R$80 thousand for the mother; R$80 thousand for the father; R$150,000 for each child she had. The defendants are jointly responsible for full payment, which means the family can demand full payment. If the accused are convicted, both they and the victims' family can appeal to higher courts.
