The plenary of the National Council of Justice (CNJ) decided this Tuesday (9), unanimously, to open an administrative disciplinary proceeding (PAD) against judge Magid Nauef Láuar, of the Court of Justice of Minas Gerais (TJMG). He is being investigated for having acquitted the accused of raping a 12-year-old girl.  Láuar has been away from his duties since the end of February, also by decision of the CNJ. The body began investigating the judge after the repercussions of the decision in which he acquitted a 35-year-old man accused of the crime of raping a vulnerable person, in Triângulo Mineiro.  Related news: Understand how the new law puts an end to mitigations for rape of vulnerable people. The investigations, however, were expanded and now also cover suspicions of sexual crimes committed during the period in which Láuar was a judge in the Minas Gerais cities of Ouro Preto and Betim.  According to the National Inspector of Justice, Minister Mauro Campbell, at least seven victims were identified and testified to the CNJ. They reported inappropriate behavior throughout the judge's career, with attacks on his house staff, interns and servants, some of whom were minors at the time of the crime.  Most of these reports were presented spontaneously by people who sought the CNJ, Campbell highlighted. Furthermore, the internal affairs department carried out a series of measures to investigate the judge's conduct, including an operation by the Federal Police (PF).  “When analyzing the victims, it was found that many of them were in a vulnerable situation, being of young age or acting as interns, employees with precarious employment, or in a situation of dependence or subordination in relation to the defendant”, described Campbell in his vote.  The minister also highlighted that there was a widespread perception that any complaint would not result in consequences for Magid Láuar, given the judge's social prestige.  “In almost all cases, the defendant forced situations of physical contact by requesting hugs from the victims when he was alone in their company,” Campbell added.  Lawyer Daniel Calazans Palomino Teixeira, who represents Magid Láuar, said that such reports concern episodes that occurred “30 years ago, 15 years ago”, and asked that the CNJ recognize the statute of limitations for the alleged crimes. The defender maintained that the statements could “constitute false memories”.  With the opening of the PAD against the judge, a new instruction will be made in the case, during which the judge will be able to once again present his version of the facts investigated.
